DAJ Terms & Conditions

These terms and conditions relate to all services that we provide, and you should read them before using any of our services including but not limited to Enquiries, Estimates, Fixed Price Work, Project Work, Installations, Repairs, Emergency Call Outs, Servicing and Guarantees.

For the purposes of these terms and conditions the following words have the following meanings: 

  • The “Company” and or “DAJ” shall mean DAJ Plumbing and Heating Ltd registered in England under number 12597370. 
  • The “Customer” shall refer to the person or organisation for whom the Company agrees to carry out works &/or supply materials.

The Company reserves the right to refuse or decline to undertake any work. DAJ also reserves the right to allocate the tradesperson to perform the service.


Fixed Rate Work

The total charge shall be given in writing as a firm cost (manifest errors exempted) inclusive of Labour and Materials. [All costs are plus the appropriate VAT]. All quotes are valid for 30 days


Written estimates maybe revised in the following circumstances if after the submission of the estimate:

1.the Customer instructs DAJ (whether verbally or in writing) to carry out additional works not referred to in the original estimate

2.there is an increase in the price of materials

3.it is discovered that further works need to be carried out which were not anticipated when the estimate was prepared

4.it is discovered that there was a manifest error when the estimate was prepared.

When you accept the DAJ fixed quotation, the deposit referred to within will become payable preferably by bank transfer however Credit/Debit card or cheque can be accepted. Upon completion you will be sent the final invoice, for which payment is due on receipt. 



Hourly Rate Work

The total charge to the Customer shall consist of:

•Labour - the amount of time spent by the tradesperson carrying out the work (being a minimum of 1 hour and then increased in 15-minute segments) including all reasonable time in obtaining non stocked materials, charged at DAJ current hourly rates for that service.

•Materials supplied by DAJ (not exceeding the list trade price plus 25% markup).

DAJ only charges for time spent on the Customers work and all other time such as lunch breaks are not included. [Where appropriate VAT is added.]

Charges are due on completion of work by Credit / Debit card on the tradespersons mobile card reader unless other arrangements were made at call out/booking. An invoice / receipt will be emailed later.


Material Collection

Collection of non-stock items is chargeable, will be kept to a minimum and should not exceed 45 minutes.


Cancellation

If the Customer needs to cancel (or rearrange) their booking they should do this as soon as they are aware by telephone. In some circumstances charges will arise as follows:

Hourly Rate work - If the Customer cancels after 12 noon of the prior working day to the scheduled booking they will be liable for the cost of any time and materials incurred by the Company, together with the profit that would have been made by the Company, in accordance with the original instruction.

Fixed Rate work – If the Customer cancels at any time they will be liable for the cost of any time and materials incurred by the Company, together with the profit that would have been made by the Company, in accordance with the original instruction.

In both cases DAJ will use its reasonable best efforts to minimise the charges to the Customer


Timekeeping

Where the date and/ or time for work is to be carried out is agreed, the Company will use reasonable endeavours to ensure that the tradesperson attends accordingly however it accepts no liability for the late or non-attendance of the tradesperson or for late delivery of material.


Late Payment Charges and Title to Goods

DAJ reserves the right to accrue and charge interest on any part of an invoice that remains unpaid at a rate of 8% per annum over the Base Rate of Barclays Bank plc until payment is received in full.

Goods supplied and delivered by DAJ, or its suppliers to the Customer shall remain the property of DAJ (or the supplier if appropriate) until paid for in full. The risk in such goods will pass to the Customer on delivery and they should be insured and store appropriately by the Customer.


Data Privacy

DAJ will hold data on a secure server in respect of services referred to in these terms and conditions. We do not sell or share data unless required to by law. Full details can be found in our Privacy Policy


Guarantee

All the DAJ labour is guaranteed for 12 months from the completion of the work in respect of faulty workmanship. This is in addition to any manufacturers warranties on any materials supplied. The Customer shall give the Company (and its insurers) the opportunity to inspect the work.


The guarantee will become null and void if the work / appliance completed/supplied by the DAJ is:

      I.subject to misuse or negligence

      II.repaired, modified or tampered with by someone other than a DAJ tradesperson.

      III.caused by a waste or drainage blockage

      IV.undertaken on instruction from the Customer against the advice of a DAJ tradesperson

Work is only guaranteed in respect of work directly undertaken by DAJ and where full payment has been received. Work subcontracted by agreement will be guaranteed by that supplier.


Where the DAJ carries out work on installations of inferior quality or over 10 years old no warranty is given in respect of such work and we accept no liability in respect of the effectiveness of such work.


Liability

The Company will only be liable for rectifying its own guaranteed work, and will not be held responsible for any ensuing damage or claims resulting from other work overlooked or subsequently requested by the Customer.

The Company will not be held liable or responsible for any damages or defects resulting from work not fully guaranteed or where recommended work has not been carried out.

The Company not be held liable for any delay, or consequences of any delay, in performing our obligations if such delay is beyond our reasonable control and we shall be entitled to reasonable time extensions.


Health and Safety

DAJ will not commence and/or continue services where the tradesperson considers there is a Health and Safety risk, including a lack of safe access, the presence of hazardous material, infestations or harassment be it physical or verbal.


General

These terms and conditions can only be varied by an Officer of Company and the Customer knowingly in writing and they prevail over any terms and conditions sent to the Company by the Customer.

These Terms and Conditions, and all contracts between us shall be construed with English law and adjudicated under the English legal system.
